TERMS AND CONDITIONS – CADBIM CENTRE
1. Acceptance of Terms & Legal Contract
These Terms and Conditions constitute a legally binding contract between you (“User,” “Student,” or “You”) and COMMANDTECH CAD & IT Private Limited, operating under the trade name “CADBIM Centre” (“Company,” “we,” “us,” or “our”).
By accessing our website cadbimcentre.com, registering for a course, paying any fees, logging into our Learning Management System (LMS), or utilizing our career placement services, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and Conditions. If you do not agree to these terms, you must immediately cease accessing or using our platform and services.
2. Eligibility & Admission

Prerequisites: Admission to specialized engineering, architectural, or drafting programs is subject to meeting recommended educational qualifications, such as a Diploma or Degree in Civil, Mechanical, Electrical, Architecture, or related technical disciplines.

Accuracy of Information: You agree to provide true, current, and complete personal and academic information during onboarding.

Right of Termination: COMMANDTECH CAD & IT Private Limited reserves the right to cancel any enrollment or deny platform access if false, forged, or misleading academic or identity details are provided.
3. Account Registration, Exclusive Use, & LMS Security

Exclusive Personal Learning Use: Access credentials, LMS portals, class links, assignment files, software guides, and community channels provided by CADBIM Centre are granted strictly and exclusively for your individual educational and personal skill development.

Non-Transferable Access: Your LMS credentials, including your username and password, are strictly personal to you and non-transferable.

Prohibition of Credentials Sharing & External Leakage: You agree never to reveal, share, transfer, lease, sell, or distribute your LMS credentials, session links, meeting passwords, or platform access to any external individual, competitor institution, agency, or third party outside the CADBIM Centre network.

Prohibited Concurrent Access: Simultaneous logins, credential sharing, or permitting unauthorized third parties to view or access course content will trigger immediate account suspension and revocation of access without any right to a refund.
4. Course Fees, Non-Refundable Registration, & Refund Policy
A. Non-Refundable Registration Fee

Every course enrollment requires a mandatory
₹3,000 Registration Fee at the time of booking.

The ₹3,000 Registration Fee is strictly NON-REFUNDABLE under any circumstances, as it covers immediate administrative overhead, seat reservation, LMS provisioning, and software onboarding costs.
B. Course Tuition Fees & Installments

Remaining course tuition fees must be paid in full or as per an approved written installment agreement prior to batch commencement.

Failure to pay installments by the designated due date will result in temporary suspension of LMS access, live class entry, and project evaluations.
C. Tuition Fee Refund Schedule
Because batch sizes are limited to maintain student-to-mentor ratios, refunds for the remaining tuition fee, excluding the non-refundable ₹3,000 registration fee, are strictly governed by the following schedule:

Refund Processing Terms: All cancellation requests must be submitted formally in writing to contact@cadbimcentre.com . Approved refunds are processed within 10–15 business days to the original payment source account.
5. Technical & Hardware Requirements
Students participating in online, hybrid, or practical modules are individually responsible for procuring hardware that meets the performance standards required by advanced BIM and CAD applications, such as Autodesk Revit, AutoCAD, Navisworks, Civil 3D, and Tekla.

CADBIM Centre shall not be held liable for learning disruptions, rendering delays, or class absences caused by inadequate student hardware or internet connection failures.
6. Intellectual Property, Data Confidentiality, & Anti-Piracy Policy

Exclusive Property: All curriculum structures, video lectures, live session recordings, training documentation, assignments, structural datasets, capstone project workflows, and BIM execution templates provided by CADBIM Centre are the exclusive intellectual property of COMMANDTECH CAD & IT Private Limited.

Strict Non-Leakage & Non-Disclosure Obligations: You explicitly agree that you shall NOT harvest, scrape, export, screenshot, extract, copy, share, disclose, or leak any internal CADBIM Centre data, including:
- LMS course content, video lectures, source files, or project models.
- Student directories, peer contact details, phone numbers, or email lists.
- Official CADBIM Centre WhatsApp or Telegram group chats, discussion links, or administrative announcements.
- Internal training methodologies, software workflows, or placement partner lists.

Prohibition of Competitor Assistance & Poaching: Sharing or leaking any CADBIM Centre data, credentials, course content, or peer/student contact details to competitor institutions, coaching centers, external marketing agencies, or commercial third parties is strictly forbidden and constitutes a severe, willful breach of trade secrets and confidentiality.

Strict Prohibitions on Content: You are strictly prohibited
from:
- Screen-recording, downloading, copying, duplicating, or broadcasting LMS video content.
- Reselling, licensing, or publicly uploading training materials to file-sharing sites, YouTube, or torrent platforms.
- Modifying or creating derivative works based on CADBIM Centre’s proprietary curriculum.

Anti-Piracy & Monitoring: System monitoring tools track account activity and IP access logs. Detecting unauthorized downloads, concurrent session usage, or data scraping will lead to immediate permanent expulsion without refund and may initiate civil lawsuits and criminal prosecution under applicable IT and copyright laws.
7. User-Generated Content & Assignment Submissions
By submitting capstone projects, assignments, 3D BIM models, architectural renders, or feedback to CADBIM Centre, you grant COMMANDTECH CAD & IT Private Limited a non-exclusive, worldwide, royalty-free license to feature your project work in institutional portfolios, marketing showcases, website success stories, and social media channels.
8. Placement Guidance & Career Services Disclaimer

Placement Support: CADBIM Centre provides career assistance, including portfolio reviews, resume building, interview coaching, and sharing candidate profiles with our employer network.

Job Placement Disclaimer: CADBIM Centre does NOT guarantee employment, job placements, or specific salary figures. Securing employment depends entirely on the student’s individual skill level, attendance, assignment completion, interview performance, and market conditions.
9. Educational Software Licenses
Where CADBIM Centre facilitates access to software licenses, such as Autodesk student accounts, such access is provided strictly for educational and training purposes only. Using student software licenses for commercial design projects, paid consulting, or freelancing violates vendor terms and will lead to immediate expulsion from the institute.
10. Student Code of Conduct, Data Misuse, & Legal Action
Students are expected to maintain professional behavior across all digital channels, live classes, and offline facilities. COMMANDTECH CAD & IT Private Limited maintains a zero-tolerance policy for data breach, credential misuse, and harassment.
A. Misuse of Data & Credential Violations
Any student found guilty of:
- Leaking or sharing LMS credentials or live class links with outsiders.

Extracting, sharing, or leaking student contact details, WhatsApp group data, or community information to competitors or third parties.

Utilizing CADBIM Centre platforms for unauthorized commercial solicitation, spamming, or poaching fellow students.

Plagiarizing assignment files or attempting to hack or bypass digital security on our LMS platform.
B. Severe Legal Consequences
Any breach involving data leakage, credential sharing, content piracy, or competitor disclosure shall immediately result in:

Immediate Account Termination: Permanent revocation of LMS access, cancellation of course enrollment, and forfeiture of all fees paid, without any right to a refund.

Legal Prosecution: Initiation of civil lawsuits for financial damages, breach of contract, and loss of business revenue, alongside criminal complaints under the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and the Indian Copyright Act, 1957.

Blacklisting & Employer Notification: Immediate blacklisting from CADBIM Centre placement assistance, cancellation of issued certificates, and notification of the breach to affiliated corporate recruitment partners.
11. Disclaimer of Warranties
The platform, courses, and materials are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied. CADBIM Centre does not warrant that platform access will be uninterrupted, error-free, or completely secure from server downtime or cyber incidents.
12. Limitation of Liability
To the maximum extent permitted by law, COMMANDTECH CAD & IT Private Limited, its brand CADBIM Centre, directors, officers, instructors, and employees shall not be liable for any direct, indirect, incidental, or consequential damages resulting from platform downtime, loss of data, failure to secure employment, or software licensing disputes with third-party software vendors.
13. Indemnification
You agree to defend, indemnify, and hold harmless COMMANDTECH CAD & IT Private Limited, its directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses, including reasonable legal fees, arising out of your violation of these Terms and Conditions, unauthorized distribution of course materials, leaking of community data, or infringement of third-party intellectual property rights.
14. Force Majeure
CADBIM Centre shall not be held liable or responsible for failure or delay in fulfilling its obligations if such performance is prevented or delayed by acts of God, war, pandemic, government lockdowns, severe network infrastructure disruptions, or cyber attacks beyond our reasonable control.
15. Governing Law & Dispute Resolution

Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of India.

Jurisdiction: Any legal action, dispute, or proceeding arising out of or related to these terms shall be subject to the exclusive jurisdiction of the competent courts located in Thiruvananthapuram, Kerala, India.
